By using this site the user has unconditionally accepted the terms and conditions of use as given hereunder and/or elsewhere in the site. 1. The user may carefully read all the information on products and services as provided in relevant sections and also in Frequently Asked Questions. 2. This site is owned by WishByCards.com division of Cryonet Technologies Pvt Ltd (here in after WishByCards.com). No material from this site or any other web site owned, operated, controlled or licensed by WishByCards.com and/or associates or sister concerns may be copied, reproduced, republished, transmitted, downloaded, uploaded or in any other manner for commercial use or otherwise without written permission of WishByCards.com. Violation of this condition is a violation of copyright and other proprietary rights of WishByCards.com and/or their associates or sister concerns or affiliates. 3. The product/services provided on this site are without warranties of any kind either expressed or implied and WishByCards.com disclaims all or any of them to the fullest extent. WishByCards.com does not warrant that the products/services offered will be error-free, or that the defects will be corrected, or that this site or the server that makes it available are or will be free of viruses or other harmful components. Any warranties or After Sale Services if any offered by the Manufacturers/Vendors on any product shall be serviced directly by such Manufacturer/Vendor and WishByCards.com shall not be under any obligation to ensure compliance or handle complaints. 4. Under no circumstances whatsoever shall WishByCards.com be liable for any loss of data, lost profits or any damages whatsoever including, without limiting, any indirect, special, incidental, consequential or other damages that result from the use of or inability to use the products/services offered in the site. Notwithstanding the foregoing, in no event shall WishByCards.com be liable to the user for any or all damages, losses, and causes of action (including but not limited to, negligence) or otherwise exceeding the amount paid by the user to WishByCards.com for that specific service/product. 5. Notwithstanding any or all of the Terms, Conditions & Disclaimers stated herein above and in FAQ or elsewhere in the site, any refund or payment by WishByCards.com to the user or anyone else acting on his behalf for any reason whatsoever, voluntarily or on being claimed by any user shall not become a waiver of any or all of the Terms, Conditions and Disclaimers made and shall not become a precedent for similar future actions/claims or confer any rights on the claiment. AND further that all such refunds/payments if any when made shall be subject to 10% deduction on account of Bank charges and other processing overheads. 6. If the user has any question, doubts or confusion in regard to any of the terms & conditions set out herein he should seek clarifications from us through Email:support@wishbycards.com and should wait for a written clarification before using the service. Other Issues Disputes: All and any disputes related to WishByCards.com service shall be subject to the jurisdiction of Muktsar, Punjab (India) courts. Payments: Prices are shown in Indian Rupees (INR) and United States Dollors (USD). The prices in USD are indicative and the billing will be in INR. There might be 1% to 2% change in the actual billing amount due to currency rate fluctuations. Accuracy of information and intent of making payment: The customer promises that the information provided to WishByCards.com will be true, current, correct and accurate including credit card numbers and addresses. The customer also agrees to pay all charges incurred by them and users of your account and credit cards or other payment mechanism at the prices in effect when such charges are incurred. Non Availability: If the ordered product is out of stock and WishByCards.com is unable to deliver the gift, a complete refund will be made to the customer. We shall not be liable for any other charges, loss of profits, emotional stress or any other liability etc caused due to the non delivery and non availability. Card Returned: Is when WishByCards.com tries to deliver the card, and is unable to do so due to either: 1. A wrong address or 2. No one being at home. And this results in card being returned back to us. Late Posting or Shipping: If the card is posted after 3 days of the "preferred date" a 25% discount will be refunded to the customer. This is provided no attempt was made by WishByCards.com. In case a shipping attempt was made and card could not be posted due to either a uncontrolled circumstances like strikes and disturbances, no refund will be given. We DO NOT ship on SUNDAYS and Public Holidays in India. Warranties are provided by the suppliers for the quality of printing and paper. WishByCards.com will pass on any warranty cards if available to the recipient of the gift at the time of delivery. THE USER OF WishByCards.com IS PRESUMED TO HAVE READ ALL THE TERMS AND CONDITIONS HEREIN AND FRQUENTLY ASKED QUESTIONS AND IS DEEMED TO HAVE AGREED, UNDERSTOOD AND ACCEPTED UNCONDITIONALLY ALL THE TERMS, CONDITIONS, PROCEDURES AND RISKS OF USING THE SERVICES AND CAN NOT AT ANY TIME CLAIM IGNORANCE OF ANY OR ALL OF THEM. ALL RELATIONSHIP OF ANY USER WHERESOEVER SITUATED IS GOVERNED BY AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF PUNJAB, INDIA. |
